In high stakes litigation, every move counts. From the initial positioning of the facts and issues, to trial of the case, to disposition of the appeal, smart moves make the difference between a favorable resolution and a costly judgment. Every step of the process matters. For business and government leaders around the world, the stakes are higher than ever in today’s competitive, media-saturated climate.
Whether facing a national or international commercial dispute, charges from a governmental agency, or a single-plaintiff suit with broad implications, prominent clients entrust their largest and most sensitive matters to O’Melveny. Although most large firms can litigate a case, few excel at shaping a dispute for trial. Positioning and trying significant , bet-the-company cases is the specialty of the lawyers of the Business Trial and Litigation ("BTL") group. No matter where the assignment is or what substantive law is at issue, we draw on our firm’s deep resources to put the best team on the field. Through cross-practice and cross-border collaboration, our lawyers can and do cover any area of law, in any jurisdiction.
For example, an international team of O’Melveny lawyers currently serves as lead counsel to Advanced Micro Devices (AMD) in its significant antitrust lawsuit against Intel Corporation based on Intel’s monopolization the x86-microprocessor industry. So far, our representation has included discovery proceedings across four continents; European Commission, Japan Fair Trade Commission, and Korean Fair Trade Commission investigations; and AMD’s victory before the US Supreme Court establishing its right to use documents obtained in the US courts in EC proceedings. We are also the lawyers to whom Jeffrey K. Skilling turned for his defense in Houston, Texas, of charges in the most significant white-collar criminal trial in decades. Most recently, our lawyers defeated multi-million dollar claims against our client, Bristol Bay Productions, in a highly publicized jury trial relating to the motion picture
Sahara.
Our goal is to find the best solution to our clients’ problems, based on a thorough understanding of the law, creativity, and adaptability to each case’s unique needs and circumstances. Thanks to effective and aggressive advocacy skills, the BTL group has prevailed in scores of trials and resolved numerous conflicts through alternative dispute resolution or settlement. At every stage of the litigation process, we help clients make the right moves.
