PLI’s International Corporate Practice (Fourth Edition): International Environmental Law

O’Melveny of counsel Eric Rothenberg and partner John Rousakis co-authored the International Environmental Law chapter in Practising Law Institute’s International Corporate Practice (Fourth Edition).

“International environmental law is a field of vast proportions, encompassing multilateral accords on a wide array of cross-border and supranational issues such as climate change, sustainable development, biodiversity, endangered species protection, fishery management, chemical and hazardous waste management, and the regulation of pollution from shipping and aircraft operations,” the authors write. “This brief treatment of international environmental law is prepared for the US corporate practitioner with an eye toward those international laws, policies, and programs that find their way into environmental reserves and capital budgets.” 

Their chapter includes overviews of global accords such as greenhouse gas limits, European Union (EU) directives with a substantial impact on companies operating both in and outside of the EU, and national laws relating to the remediation of contaminated land.

As co-lead of O’Melveny’s Environmental, Health, and Safety Practice, Rothenberg represents clients in superfund proceedings, toxic tort claims, private cost recovery actions, and administrative proceedings. Drawing upon his experience as a graduate-degree environmental engineer, he also directs diligence and documentation of transactions, financings, and restructurings/reorganizations involving industrial and commercial properties. Additionally, he advises on ESG matters, and serves as lead counsel and court-appointed allocation counsel at National Priorities List superfund sites.

A former General Counsel at the NYC Department of Environmental Protection, Rousakis advises clients on industrial and energy acquisitions and divestitures, on infrastructure development and real estate projects, and in federal and state Superfund matters. He also provides strategic and regulatory counseling on a range of environmental, health, and safety and ESG matters.
