GAR North America: US Decisions Impacting International Arbitration

September 16, 2025

O’Melveny partner Meghan McElvy will be a guest speaker at GAR Live 2025, joining a panel discussion on current international arbitration cases and their implications for the US. McElvy represents clients in high-stakes commercial litigation and arbitration across the energy sector, including oil and gas, renewables, LNG, and related infrastructure. With over 15 years of experience, she advises on matters spanning upstream development, midstream transportation, offshore decommissioning, and regulatory compliance.

“The US Supreme Court has an unusually high number of cases with a bearing on international arbitration ahead.” This panel will go beneath the surface of cases and explore what the outcomes do/may mean for practice in the US.” Discussions are expected to include:

  • Interpretation of sovereign immunity cases – fallout from the CJEU’s intra-EU investment arbitration ruling
  • Practical limits to enforcing awards – the contested CITGO auction
  • How do the US courts treat states refusing to comply with awards?
  • Anti-suit injunctions
