IPWatchdog: Litigation Masters™ 2024

O’Melveny senior counsel Coke Morgan Stewart will be a featured speaker at the Fourth Annual Patent Litigation program, a part of the IPWatchdog Masters™ series, at the IPWatchdog Studios. The program will explore the most active federal district courts in the United States, patent litigation at the Unified Patent Court (UPC), and patent litigation in both Brazil and Germany. They will also discuss appeals to the United States Court of Appeals for the Federal Circuit as well as substantive topics including, working with experts, strategies for dealing with nuisance lawsuits brought by patent trolls, and SEP litigation.

Coke Morgan Stewart’s session will explore winning and losing at the Federal Circuit. A feat which can appear arbitrary and panel dependent despite the many attorneys that have a very high win percentage when representing clients at the Federal Circuit.

The panel will consider the following:

  • What have these attorneys learned about the secret to success on briefs and during oral argument?
  • How can appellants and appellees increase their chances of winning at the Federal Circuit?
  • What are the best practices for arguing certain issues?
  • How can you structure an argument to maximize your chance to prevail?
  • Is there anything you can and should do in district court or at the PTAB that will influence your chances of prevailing on appeal?”
