A series of court decisions and regulatory changes from federal agencies (e.g., the Small Business Administration and Department of Transportation) regarding supplier diversity programs have required eliminating race- and sex-based presumptions of social or economic disadvantage. This panel will discuss the shift to an “individualized showing” of disadvantage, in the business contracting context and more broadly across the diversity policy landscape.
