O’Melveny Earns Multiple Awards at 2023 National Law Journal Awards

WASHINGTON, DC—October 31, 2023—O’Melveny received two prestigious honors at The National Law Journal’s 2023 Legal Awards: The firm was named to the publication’s Appellate Hot List and partner Mattie Hutton was recognized as a DC Rising Star.
According to The National Law Journal, the “selected law firms and attorneys have not only gone the extra mile for their clients, but have proven successful implementation of innovative approaches to litigation and legal advisory work.”
In being named to the Appellate Hot List, O’Melveny was lauded for securing a major victory at the US Supreme Court on behalf of Louis Ciminelli, when the justices unanimously disposed the “right-to-control” theory of fraud in a case involving conspiracy to commit wire fraud.
“It’s hard to call any one win our ‘best,’ but Ciminelli not only was a great victory for our client, it also has the much broader effect of reigning in the federal government’s longstanding and vastly overboard interpretation of the Wire Fraud statute,” said O’Melveny partner Jonathan Hacker, who chairs the firm’s Supreme Court and Appellate Litigation Practice. “The government had for years been relying on the ‘right to control’ theory to convict countless defendants for actions that were never violations of the law at all.”
Recognized by The National Law Journal as a DC Rising Star and one of Washington, DC’s most promising lawyers under the age of 40, Mattie Hutton is a veteran member of O’Melveny’s Consumer Class Action and Product Liability Practice Groups and has led case teams through all stages of pretrial discovery, class certification, motions practice, and trial.
“For nearly a decade, I defended pelvic mesh consumer fraud and products liability litigation at trial and on appeal,” Hutton said. “Many of these cases were state attorneys general actions, with significant resolutions, including a 40+state settlement in 2019, and an appellate write-down of a trial-court award in 2022. In February 2023, we resolved the last outstanding attorney general action against my client, a trial-set case against the Kentucky Attorney General.”
