Lisa Pensabene and an O’Melveny team secured a post-trial win for Amgen, knocking out a verdict of more than US$50 million that Lindis Biotech won last year in patent infringement litigation involving Amgen’s leukemia medication Blincyto. US District Judge Gregory Williams, in a decision unsealed this week, found that Lindis Biotech’s patents were invalid because of inequitable conduct before the Patent Office—specifically, the inventor failed to turn over studies the judge found material to patentability. In addition to Pensabene, the O’Melveny team advising Amgen included partners Hassen Sayeed and Luann Simmons, counsel Sorin Zaharia, special counsel Lindsay Autz, and associate Amy Zhao.
