Law360: DOJ Gears Up For Chicken Price-Fixing Retrial

The US Department of Justice is lining up more witnesses for a retrial accusing 10 poultry executives of a chicken price-fixing scheme. US District Judge Philip A. Brimmer declared a mistrial on December 16, 2021 following a 29-day day trial where the jury could not reach a verdict. The executives moved to have the case dismissed after the mistrial, but Judge Brimmer found that former Pilgrim Pride employee Robbie Bryant’s testimony proved the existence of a conspiracy. The new trial begins on Tuesday, February 22, 2022 and is expected to last 22 days. Former Pilgrim’s Pride CEO Jayson Jeffrey Penn is represented by Michael F. Tubach, Anna T. Pletcher, and Brian P.
