Law360: PTAB Filings Drop Alongside Declining Patent Litigation

A new report from Lex Machina reported that the number of America Invents Act petitions filed at the Patent Trial and Appeal Board decreased in 2023, from approximately 1,300 IPR petitions for inter partes review to 1,157. O’Melveny & Myers LLP partner Tim Fink said that PTAB trends “often ebb and flow” based on the rate of district court litigation.
