As companies turn to artificial intelligence for competitive research and product development, trade secrets law’s flexible standards regarding what constitutes “improper means” of acquiring a competitor’s proprietary information are being tested in new ways. “The flexibility of’ ‘improper means’ is a core tenet and benefit of trade secret law,” said O’Melveny partner and chair of the trade secrets group David Almeling. “That term isn’t static, meaning that what is ‘improper’ has evolved from the pre-digital era through today.”
