Law360: Worker’s 10th Circ. Loss May Aid Future DEI Challenges

The Tenth Circuit declined to a revive a harassment and discrimination case in which a former Colorado Department of Corrections officer made claims relating to a workplace presentation on racial inequality. “One principle that hasn't changed in these recent decisions is that training to promote an inclusive work environment does not alone violate the law,” said O’Melveny partner Tristan Morales, who heads up the firm’s DEI and affirmative action task force. “Indeed, it may help employers reduce the risk of discrimination or bias claims to the extent it helps ensure that the workplace is free from harassing incidents or discriminatory conduct or ridicule.”
