There were 42 antitrust class actions filed against various industries last month, which is 71% higher than the average monthly rate over the past year. Simultaneously, the private plaintiffs bar and government regulators have pursued antitrust investigations. “There are a lot of lawyers involved in this space who 10 years ago weren’t involved in this space, particularly as to private plaintiffs,” said O’Melveny partner Anna Pletcher, a former Justice Department prosecutor. “We’re seeing a convergence of an interest in the plaintiffs bar in bringing types of these cases as enforcers, and the enforcers are then also stepping up as well.”
