Former University of Michigan head coach Sherrone Moore was terminated “with cause” after the school alleged he had an improper workplace relationship and was later arrested and jailed as a suspect in an alleged assault. Moore’s “for cause” dismissal could revoke the US$13.89 million he would have been owed over the next two remaining years of his contract. “These situations come down to the terms of the parties’ contract and how the parties defined ‘for cause’ in the contract,” said O’Melveny partner Tim Heafner. “Typically, violations of a university policy, which is what has been alleged here, or violations of the law are grounds for termination for cause.” Heafner added: “Generally, a ‘for cause’ firing would be a violation of the contract, and terminate the university’s obligation to continue to pay going forward.” This story was also covered by Morningstar.
