The National Law Journal: Ex-Judge Assails Former Law Clerk John Eastman’s Jan. 6 Theory as ‘Constitutional Mischief’

Testimony was heard yesterday from former Vice President Mike Pence’s chief counsel Greg Jacob before the House Jan. 6 committee. Jacob, now a partner at O’Melveny & Myers LLP, told the committee that former President Trump’s lawyer John Eastman attempted to persuade Pence that he could reject electors in the 2020 presidential campaign. Pence was advised by Jacob that he had no authority to delay or overturn election results. “In the long-term we would have established a situation where a vice president would have asserted that one person could have the power to determine the outcome of elections, which is antithetical to everything in our democracy,” Jacob said. “Antithetical to the rule of law.”
