The Washington Post: Sam Bankman-Fried’s Legal Peril Deepens as His Defense Comes Up Short

Former federal prosecutors say that Sam Bankman-Fried’s chances of defeating criminal fraud charges are growing weaker as his trial continues in its third week. O’Melveny partner Rebecca Mermelstein said of the defense there is “no question they’re having a really hard time.” Judge Lewis A. Kaplan, who is overseeing the case, told lawyers to look into the “buried facts doctrine” during the first week of trial. “I was very surprised by that,” Mermelstein said. “Judges don’t usually offer strategic suggestions to the parties.”
