O’Melveny Achieves Federal Circuit Win After 13-Year Patent Dispute For Google

SAN FRANCISCO—August 24, 2023—O’Melveny represented Google in the U.S. Court of Appeals for the Federal Circuit, obtaining affirmances of U.S. Patent Office (“PTO”) decisions invalidating four patents asserted by plaintiff Vederi, LLC. This decision comes after 13 years of litigation, including a district court case, four inter partes reexamination proceedings before the PTO, several resulting decisions from the PTO, and two prior appeals to the Federal Circuit.
The dispute began in 2010, when Vederi sued Google in the Central District of California, accusing Google’s Street View of infringing four patents. Google challenged the validity of the patents by filing inter partes reexaminations at the PTO. In 2015-16, the PTO issued decisions siding with most of Google’s challenges. Both Vederi and Google then appealed to the Federal Circuit, which in 2020 remanded to the PTO to reconsider invalidity based on revised interpretations of the patents’ claims. On remand, the PTO found all claims invalid. Vederi appealed. Following oral argument, the Federal Circuit affirmed the PTO’s decisions.
