San Bernardino Sun: San Bernardino Violated Rights of Homeless Residents Living in Parks, Claim Alleges

Lenka John, James Tyson, and Noel Harner filed a claim against the City of San Bernardino alleging that it violated their constitutional rights under the Americans with Disabilities Act. The three plaintiffs, who have mobility impairments and are experiencing homelessness, said that they were put in danger after they were ordered to vacate city parks where they were living. The claim stems from the city’s recent initiative to clean the parks. The plaintiffs are represented by O’Melveny, the ACLU Foundation of Southern California, and Santa Ana’s Elder Law and Disability Rights Center.
