Jason Yan is a well-rounded litigator and trusted advisor with extensive experience guiding clients through complex and cutting-edge issues relating to competition, healthcare, and artificial intelligence. He has a wide range of experience across varying industries, with a focus on counseling healthcare payors and airlines.
Jason is adept at navigating every stage of litigation, but has a particular affinity for working with expert witnesses. In that role, Jason has leveraged his scientific and analytical background to serve as an effective conduit between legal audiences and experts in the fields of economics, statistics, actuarial sciences, medicine, psychology, healthcare claims data, and medical coding.
Most recently, Jason represented Alaska Airlines through the regulatory review process for its acquisition of Hawaiian Airlines, which successfully closed ahead of schedule when the Department of Justice and Department of Transportation completed their investigations without seeking to block the merger. In 2018, Jason was one of the core members of the trial team that defended AT&T and Time Warner in the “antitrust trial of the century,” defeating an attempt by the Department of Justice to block the $85 billion merger.
Jason is also a trusted advisor outside the courtroom, offering guidance to clients throughout the course of setting company strategy, conducting internal investigations, responding to government inquiries, and engaging in informal advocacy before government agencies in connection with over a dozen confidential and/or otherwise sensitive matters.
Most recently, Jason was one of the core members of the trial team that defended AT&T and Time Warner in the “antitrust trial of the century,” defeating an attempt by the Department of Justice to block the $85 billion merger that has forever changed the landscape of the telecom and media industry. Jason is also a trusted advisor outside the courtroom, offering guidance to clients throughout the course of conducting internal investigations, responding to government requests, and engaging in informal advocacy before government agencies in connection with a number of confidential and/or otherwise sensitive matters.
- Advised multiple healthcare payor clients in connection with confidential internal investigations and responding to government requests for information on a range of topics including Artificial Intelligence,
- Medicare Advantage Risk Adjustment, and antitrust compliance.
- Represented Alaska Airlines and obtained government clearance of its acquisition of Hawaiian Airlines.
- Represented UnitedHealth Group in multiple parallel litigations brought by nationwide physician staffing company.
- Counseled multiple airlines on antitrust issues relating to joint ventures and alliances.
- Represented international importer and manufacturer in an investigation by the Department of Justice and Customs and Border Protection.
- Defended $85 billion AT&T-Time Warner merger against challenge by the Department of Justice.
- Obtained favorable settlement for Honeywell International Inc. in private litigation alleging violations of
- Section 2 of the Clayton Act in connection with the manufacture and sale of electronic fire and security products.
- Obtained favorable settlement for Humana Inc. in bellwether False Claims Act qui tam suit alleging reverse false claims and submission of false diagnosis data supplied by Florida-based physician’s office.
- Prepared written comments and expert support on behalf of multiple Medicare Advantage Organizations in connection with public notice-and-comment on the Centers for Medicare and Medicaid Services proposed RADV audit methodology.
