Kelly is a litigation counsel in O’Melveny’s Washington, DC, office. She represents a broad range of clients in a variety of matters including business and commercial disputes, shareholder securities class actions, enforcement actions, and internal investigations.
Kelly serves as the co-chair of two committees in O’Melveny’s Washington, DC, office: the Women Attorneys’ Affinity Group and the Associate and Counsel Advisory Committee. She previously served in similar capacities on the Los Angeles office’s versions of these committees and on its Community Involvement Committee. In addition to Kelly’s firm involvement, she served on the Board of Governors for the Women Lawyers Association of Los Angeles from 2019 to 2021.
Kelly’s litigation and investigation experience includes:
- Representing health care organizations in investigation, regulatory, and litigation matters involving the federal False Claims Act, Medicare and Medicaid regulations, and the ACA.
- Representing a government contractor in a self disclosure to the Department of Justice and other agencies related to potential False Claims Act violations.
- Representing corporate and individual clients in connection with criminal investigations by local United States Attorneys’ Offices.
- Representing the sponsor of real estate investment trusts in a securities enforcement action.
- Representing a major distillery company in an internal corporate review.
- Representing a pharmaceutical company in an internal investigation related to the federal Anti-Kickback Statute.
- Representing the Audit Committee in the investigation of whistleblower allegations concerning accounting, financial reporting, and auditor independence issues for a major toy company.
- Defending a global retail company and its officers in a 10b-5 class action.
- Defending a foreign steel manufacturer in various contractual disputes.
- Defending a major health insurance company in a series of litigations related to contract disputes with a private-equity-owned provider group.
- Obtaining dismissals for individual officers and directors in derivative litigations following an environmental incident.
- Representing a cosmetics packaging company in its litigation against a former employee who obtained kickbacks from suppliers.
- Representing a museum in resolving contract disputes and recovering wrongfully withheld artifacts.
- Representing a large university system in a highly sensitive transaction.
- Counseling a biomedical device manufacturer on various regulatory matters.
- Representing a pro bono client in immigration proceedings.
