O’Melveny Worldwide

Miao Liu is a litigation counsel in O’Melveny’s Washington, DC office. Miao focuses his practice in district court litigation, PTAB proceedings, and ITC investigations. Miao advises clients in various technological fields, including consumer electronics, artificial intelligence, blockchain and cryptocurrency, computer products, semiconductor manufacturing and inspection, and satellite communication.

Prior to joining O’Melveny, Miao worked in private practice at an international IP specialty firm. He also gained extensive experience during his more than 10-year tenure as a Technical Advisor and Patent Agent with another IP boutique firm. He is experienced in conducting patent searches, providing patentability reports, as well as providing non-infringement and invalidity analysis. 

Miao was a software engineer prior to becoming a patent agent. Miao focused on logic programming and artificial intelligence research during his graduate studies. He has published several research papers, including one in the Journal of Applied Logic.

PTAB Matters

  • Prepared IPR Petitions on behalf of Uber Technologies challenging the validity of patents related to location tracking devices, resulting in determinations that the challenged claims are unpatentable
  • Prepared IPR Petition on behalf of SharkNinja challenging the validity of a patent related to navigation of cleaning robot, resulting in cancellation of all claims of the challenged patent

District Court Matters

  • Defended Samsung against Scramoge in a series of cases filed in Western District of Texas involving patents relating to wireless charging for smartphones and tablets
  • Won a false advertising class-action case on summary judgement for defendant Colgate-Palmolive and Tom’s of Maine
  • Represented Tata Consultancy Services against Computer Sciences Corporation in a trade secret litigation that required complex analysis of source code for life insurance and annuity products

International Trade Commission (ITC) Matters

  • Defended Samsung against Daedalus Prime in an ITC investigation involving patents relating to computer processors
